We have three commission for air accidents:
1)
the State Commission for Investigation of Air Accidents. This is a civilian commission under the control of the Ministry of Infrastructure. This commission investigates accidents and incidents in
civil aviation. The chief od this commission since 2006 is Edmund Klich (and he was
not dismissed from
that post). This commission does not work in Smoleńsk.
2) a (constant) military commission, internal to the Ministry of Defense:
the Ministry of Defense Commission for Investigations of Air Accidents. This commission deals with incidents and accidents pertaining solely to military aircraft. For instance, this particular commission prepared the report concerning the catastrophe of the CASA military transport aircraft in 2008. The commission mostly deals with all sorts of
internal military incidents. The commission does not work in Smoleńsk.
3) the bill of Air Traffic Law of 2002 allows the Minister of Defense to constitute a special commission, designed to investigate an air accident in the
state aviation (either military or state security aviation), which is referred to as:
The State Commission for Investigation of Air Accidents in the State Aviation. This commission deals with a particular incident and it remains under control of the Minister of Defense. And this is the commission that works in Smoleńsk - cooperating with MAK.
When the accident in Smolensk occurred, the Minister of Defence (Bogdan Klich) has established the special commission to investigate. This was the case #3 of the above. Now. Mr Edmund Klich was assigned (by defense Minister Bogdan Klich after being approved by Tusk) to become the chief of this particular commission. He was a civilian at the moment, although he was also a retired полковник of the air force, hence, he could become the chief of a military commission. Only this commission, and no other one, works in Smoleńsk.
And today, the prime minister Tusk said, that Edmund Klich had resigned from being the chief of the commission, meaning - the commission #3 (that is the
military commission working in Smoleńsk).
